Terms of Service

What we promise, what we expect. Short, no legalese fog.

Version in force This is the current edition of the terms. Contracts already concluded remain governed by the edition accepted at signup. We give 30 days notice by email before any material change.

1. Parties

Provider: Hostika EOOD, registered office ul. Louis Ayer 13, 1404 Sofia, Bulgaria. The company is not registered for VAT. Customer = the individual or legal entity using the services.

2. Services

Hostika provides: web hosting, domain registration, website creation, email hosting, migration, support, and related services. The exact scope per subscription is described in the relevant plan or individual offer.

3. Pricing and payment

Prices are in EUR. Hostika EOOD is not registered under the Bulgarian VAT Act and does not charge VAT — the advertised price is the final price. Customers will be notified in advance should that change. Monthly subscription, paid in advance. Service may be suspended for payments overdue by more than 14 days; restoration follows payment.

4. Term and termination

Monthly contract with no minimum term. Termination anytime with 14-day notice via the client area or email. Once the period in §4a has passed, paid but unused periods are not refunded unless the plan specifies otherwise.

4a. Right of withdrawal (consumers)

If you are a consumer within the meaning of the Bulgarian Consumer Protection Act, you have the right to withdraw from the contract within 14 days of concluding it, without giving a reason. Notify us at legal@hostika-bg.com or by any clear written statement; you may also use the standard form in Annex 6 to the Act. We refund within 14 days of receiving your notice, using the same payment method. If you expressly asked us to begin performance before that period expires (for example, to activate the service immediately) and acknowledged that you thereby lose the right of withdrawal once performance is complete, you owe a proportionate amount for what was actually provided up to the moment of withdrawal. The right does not apply to services fully performed with your express prior consent, nor to work made to your individual specification (чл. 57 ЗЗП).

5. Availability

We aim for 99.5% monthly availability and publish the real measurements at /status.php. This is a target, not a contractual guarantee with automatic credit. If the service is unavailable through our fault for more than 4 consecutive hours, contact us and we will compensate the corresponding part of that month's fee. Exceptions: scheduled maintenance announced in advance, force majeure, and problems outside our infrastructure.

6. Acceptable use

Prohibited: spam, phishing, malware, IP infringement, illegal content, excessive load on shared infrastructure (mining, file-sharing nodes), actions in violation of Bulgarian or EU law. Violation → warning → suspension → termination.

7. Backups and data responsibility

We maintain daily backups with 14-day history. Backups are encrypted and stored on a separate server. Backups are a service, not a guarantee — we recommend customers keep their own copies of critical data. Restoration on request is free.

8. Limitation of liability

Our liability is limited to the amount paid for the service in the prior 12 months. We are not liable for lost profits, indirect damages, or third-party consequences from site use. We are not responsible for content the customer publishes.

9. Changes to the service

We may change features, pricing, or terms with 30 days email notice. If a change is materially adverse to you, you may terminate without penalty before it takes effect.

10. Personal data

Personal data processing is described in our Privacy Policy (/privacy.php). When we process third-party data (your end users) on your behalf we act as a processor under GDPR. The article 28 agreement is published at /dpa.php and applies automatically to every active contract — you do not need to request it.

11. Governing law and disputes

Governed by Bulgarian law. Disputes are first addressed through negotiation; failing that, by the competent Bulgarian court in Sofia. Consumers retain their rights under the Consumer Protection Act.
