Terms of Service

What we promise, what we expect. Short, no legalese fog.

1. Parties DRAFT — pending legal review

TBD: full registered company name, EIK, VAT, registered office. Customer = the individual or legal entity using the services.

2. Services

Hostika provides: web hosting, domain registration, website creation, email hosting, migration, support, and related services. The exact scope per subscription is described in the relevant plan or individual offer.

3. Pricing and payment

Prices are in EUR, VAT included for Bulgarian end customers, VAT excluded for VIES-registered EU businesses. Monthly subscription, paid in advance. Service may be suspended for payments overdue by more than 14 days; restoration follows payment.

4. Term and termination

Monthly contract with no minimum term. Termination anytime with 14-day notice via the client area or email. Paid but unused periods are not refunded unless the plan specifies otherwise.

5. Service Level Agreement (SLA)

We guarantee 99.95% monthly uptime on hosting plans. On miss — account credit proportional to downtime. Exceptions: scheduled maintenance with advance notice, force majeure, issues outside our infrastructure.

6. Acceptable use

Prohibited: spam, phishing, malware, IP infringement, illegal content, excessive load on shared infrastructure (mining, file-sharing nodes), actions in violation of Bulgarian or EU law. Violation → warning → suspension → termination.

7. Backups and data responsibility

We maintain daily backups with 14-day history (JetBackup). Backups are a service, not a guarantee — we recommend customers keep their own copies of critical data. Restoration on request through the client area is free.

8. Limitation of liability

Our liability is limited to the amount paid for the service in the prior 12 months. We are not liable for lost profits, indirect damages, or third-party consequences from site use. We are not responsible for content the customer publishes.

9. Changes to the service

We may change features, pricing, or terms with 30 days email notice. If a change is materially adverse to you, you may terminate without penalty before it takes effect.

10. Personal data

Personal data processing is described in our Privacy Policy (/privacy.php). When we process third-party data (your end users) on your behalf, we act as a processor under GDPR — a DPA is available on request.

11. Governing law and disputes

Governed by Bulgarian law. Disputes are first addressed through negotiation; failing that, by the competent Bulgarian court in Sofia. Consumers retain their rights under the Consumer Protection Act.
